The Telecommunications Act, 2023 replaces the Indian Telegraph Act, 1885, to modernize the regulatory framework for telecommunication services and networks. The Act specifies contraventions and provides a structured mechanism for adjudication and the protection of telecommunication infrastructure.
Protection of Telecommunication Infrastructure (Section 14)
Section 14 provides legal safeguards to ensure the continuity of telecommunication services. Under Section 14(4), no public entity or person can take coercive action—such as sealing, preventing access, or forcible shutdown—of a network established by an authorized entity without the prior written permission of the designated Authorized Officer.
In the case of Maharashtra, the Central Government (via S.O. 72(A)) has designated the Secretary (Information Technology), Government of Maharashtra, as the Authorized Officer for this purpose.
Procedure for Filing a Complaint/Application
Every application for adjudication or for seeking permission for coercive action under Section 14(4) must follow the prescribed procedure:
- Submit a letter in the name of the Secretary, stating the issues and related prayers therein.
- Evidence: The complainant/applicant must furnish identity proof and clear supporting evidence, such as photographs, location data, or technical reports.
