Adjudication under Information Technology Act
- The Secretary, Information Technology Department, Maharashtra, acts as the Adjudicating Officer under Sec 46 of Information Technology Act, 2000.
- Jurisdiction:Claims involving injury or damage up to ₹5 crore.
- Powers:Equivalent to a Civil Court, as provided under Section 58 of the Information Technology Act, 2000.
Procedure for Filing a Complaint
To file a complaint for the adjudication
- Submit an application in the prescribed format.
- Attach:
- Full details of the complainant and also Respondent(s).
- Brief Summary of the Cases.
- Dates an Events.
- Plaint with Prayer(s).
- Evidence/documents.
- Identity proof.
- All the documents shall b notarized.
- A copy of any original document shall be a True Copy stamped.
- Pay the prescribed fee (details below).
- Submit to the Adjudicating Officer.
Updated Fee Structure (Maharashtra)
Fees:
Every complaint of a matter to the Adjudicating Officer shall be accompanied by fee, payable by a bank draft drawn in favour of “Adjudicating Officer, Information Technology Act” at the place of functioning of Adjudicating Officer in the State or Union Territories, calculated on the basis of the damages claimed by way of compensation from the contraveners on the rates provided below:
- Fee Structure:Every complaint of a matter to the Adjudicating Officer shall be accompanied by Application fee of Rs. 50/- and fee towards damages claimed by way of compensation from the contraveners, payable by a bank draft drawn in favour of “Adjudicating Officer Information Technology Act” at Mumbai, Maharashtra, calculated on the basis on the rates provided below.
